Carers Act Update

From 1 April 2018, a new law [Carers (Scotland) Act 2016] regarding carers will come into effect. The intention of this new law is to ensure that unpaid carers who are able and willing to continue caring would be better supported in their caring roles. For clarification, unpaid carers are individuals who look after someone but are not paid to do so regardless of whether they receive benefits or pensions. Under the new law, adult carers will have a right to Adult Carer Support Plans and young carers will have a right to Young Carer Statements. You can either request this or be offered one from 1 April 2018. These replace current carers assessments and will provide an opportunity for carers to have a say into their own needs, personal outcomes and support.

The law also requires each local authority to develop a local eligibility criteria framework, setting out the level of support a carer would receive based on their needs and personal outcomes. You may remember that we ran a consultation in conjunction with Perth & Kinross Council regarding Perth & Kinross’ draft eligibility criteria for carers towards the end of 2017 as part of the implementation of the Carers (Scotland) Act 2016. You can now download the finalised Adult Carers Eligibility Criteria Framework for Perth & Kinross (click here to download), which will take effect from 1 April 2018. After the consultation, Perth & Kinross Council decided to develop a separate eligibility criteria for young carers so this is part is still in process.
